Service Agreement
By joining the Spark Pro Wrestling Dojo, I ("the Trainee") acknowledge that I have read, understood, and accept all of the following terms:
This release and waiver of liability releases Spark Pro Wrestling Dojo, SJPA Entertainment LLC, Trainers, Officers, Employees and Volunteers. The Trainee, and/or the child or children of whom the Trainee represents as legal guardian, desires to voluntarily engage in training programs provided by the Spark Pro Wrestling Dojo.
Trainee understands that the scope of Trainee’s relationship with the Administrator and the Dojo Facilities is limited to the use of this facility and for the purpose of pro wrestling training. The Administrator and the Dojo Facilities are not responsible for the health and well being of the Trainee. Trainee is responsible for obtaining the appropriate forms personal insurance coverage in the event of personal injury or illness as a result of training and activities performed at the Spark Pro Wrestling Dojo facilities.
1. Waiver and Release: I, the Trainee, release and forever discharge and hold harmless Spark Pro Wrestling Dojo, SJPA Entertainment LLC, Trainers, Officers, Employees and Volunteers and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from activities related to the Spark Pro Wrestling Dojo, pro wrestling training, and participation in pro wrestling events. I understand and acknowledge that this Release discharges Spark Pro Wrestling Dojo, SJPA Entertainment LLC, Trainers, Officers, Employees and Volunteers from any liability or claim that I may have against Spark Pro Wrestling Dojo, SJPA Entertainment LLC, Trainers, Officers, Employees and Volunteers with respect to bodily injury, illness, death, or property damage that may result from the participation in pro wrestling and/or related activities or occurring while my child is engaged in pro wrestling and/or related activities.
2. Insurance: Further, I understand that Spark Pro Wrestling Dojo, SJPA Entertainment LLC, Trainers, Officers, Employees and Volunteers do not assume any responsibility for or obligation to provide my child with financial or other assistance, including, but not limited to medical, health or disability benefits or insurance of any nature in the event of my injury, illness, death or damage to my property. I expressly waive any such claim for compensation or liability on the part of Administrator and Dojo Facilities in the event of such injury or medical expenses incurred by myself and/or my child.
3. Medical Treatment: I hereby Release and forever discharge Spark Pro Wrestling Dojo, SJPA Entertainment LLC, Trainers, Officers, Employees and Volunteers from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my participation in pro wrestling and/or related activities.
4. Assumption of Risk: I understand that pro wrestling training may include activities that may be hazardous to myself and/or my child including, but not limited to those activities commonly engaged in during pro wrestling events, involving inherently dangerous activities. I hereby expressly assume the risk of injury or harm from these activities and Release Administrator and Dojo Facilities from all liability for injury, illness, death or property damage resulting from pro wrestling training or occurring while I and/or my child is engaged in pro wrestling training and/or related activities.
5. Photographic Release: I grant and convey to SJPA Entertainment LLC all right, title, and interest in any and all photographs, images, video footage, or audio recordings of myself and/or my child’s likeness or voice which may be captured by the Administrator in connection with my or my child’s engaging in pro wrestling training and related activities.
6. Other: As a Trainee, I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Florida and that this Release shall be governed by and interpreted in accordance with the laws of the State of Florida. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall remain in effect.
By continuing to participate in activities held at the Spark Pro Wrestling Dojo, the Trainee hereby understands and agrees to all of the terms of this agreement and waiver.
